Terms of Service

1. The Service

BelloCloud lets you deploy, run, and manage subscription-based commerce applications such as BelloCommerce on managed infrastructure. We handle hosting, updates, and monitoring so your apps stay available. Features may evolve over time. BelloCloud LLC also publishes BelloSend (bellosend.net), and owns and operates BelloPOS (bellopos.app) jointly with Rankaya Media LLC, which is the merchant of record for BelloPOS payments; when you buy those products, their own terms and policies apply alongside these Terms.

2. Accounts & Organizations

• You must provide accurate information when creating an account and keep your credentials secure.
• You must confirm your email address and provide company details before deploying apps.
• You may create one or more organizations and invite team members with specific roles and permissions.
• You are responsible for all activity under your account and organizations, including actions by invited members.

3. Subscriptions, Payments & Balance

• Apps are offered on subscription plans billed as described at checkout.
• Payments are processed by PayPal or other listed processors; you may also top up an account balance.
• BelloCommerce subscriptions are paid in advance for each billing period and do not renew automatically: nothing is charged without your action. You renew by paying for the next period; if you do not pay, the subscription simply ends at the end of the period already paid. You can cancel at any time by email to bellocommerce@bellocloud.com.
• Refunds and cancellations follow our Refund & Cancellation Policy: BelloPOS licences and the first payment of a new BelloSend or BelloCommerce subscription carry a 14-day money-back guarantee; renewals and other payments are non-refundable, except where required by law or where we failed to deliver the service.
• We may change prices with prior notice; changes apply from the next billing cycle.

4. Acceptable Use

You agree not to misuse the Service. In particular, you will not:

• Use the Service for unlawful, fraudulent, or abusive activities.
• Attempt to gain unauthorized access to infrastructure, other customers’ deployments, or data.
• Resell the Service or circumvent usage limits without our written consent.
• Upload malicious code or interfere with the operation of the platform.

5. Your Content & Data

You retain ownership of the data and content processed by the apps you deploy. You grant us the rights needed to host and operate that data solely to provide the Service. You are responsible for the legality of the data you and your customers process on the platform.

6. Intellectual Property

The Service, including its software, design, and trademarks, is owned by BelloCloud LLC and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service while your subscription is active.

7. Termination

You may cancel your subscriptions or delete your account at any time by email (for BelloCommerce, to bellocommerce@bellocloud.com). We may suspend or terminate access for breach of these Terms, non-payment, or risk to the platform. Upon termination, your deployed apps are stopped and their data deleted after a short grace period.

8. Disclaimers & Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, BelloCloud LLC is not liable for indirect, incidental, or consequential damages, loss of profits, or loss of data. Our total liability is limited to the amounts you paid for the Service in the twelve months preceding the claim.

9. Governing Law & Changes

These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-law rules, and any dispute will be brought before the state or federal courts located in New Mexico, unless mandatory consumer law in your country provides otherwise. We may update these Terms; material changes will be announced on this page with an updated date. Continued use of the Service after changes means you accept them.
